The rapid development of digital technology has had a significant impact on social and legal life, one of which is the emergence of the criminal act of secretly disseminating obscene content. This crime often involves violations of individual privacy rights, in which the victim’s personal data, such as intimate images or videos, are obtained and distributed without consent. Such criminal acts threaten the dignity and honor of the victims and violate their right to personal data protection. Law Number 27 of 2022 on Personal Data Protection (PDP Law) serves as the legal basis for safeguarding the right to privacy and personal data; however, challenges remain in its implementation, particularly in ensuring fair and equal law enforcement.
